These are the terms and conditions used in our Toton Lane showroom.

The company reserves the right to make fair and reasonable charges for abandoned deliveries or where the client fails to notify the company of any change in delivery circumstances.

Cancellation

A request for a cancellation in writing is preferred for the purpose of traceability and accuracy.

A request to cancel for any reason may result in the loss of your deposit in full or in part depending on the individual circumstances.

This includes the result of a detrimental change in circumstances where the product or service may no longer be appropriate or necessary or in the event of death.

There are varying rights to cancel dependant on how and where the contract is formed. As per the Cancellation and Additional Charges) Regulations 2013.

(a) If your contract or purchase was formed on our business premises there are no automatic rights to cancel.

(b) If your contract is formed in your home, or away from our business premises IE at the time of our representatives visit and a deposit is paid at that point you will be issued with a right to cancel notice giving you 14 days to exercise your right to cancel and any monies paid will be returned in full. The exception to that would be where the goods are clearly personalised or manufactured to suit your personal needs such as dimensions, functions and significant performance criteria that will render the item as bespoke, eg a custom made element.

(C) Where a quotation is accepted at a later time ie, after but not during a home visit from our representative, again there are no automatic right to cancel.

Telephone orders

Orders received over the telephone or any other medium such as text or a messaging service with no face to face contact will also have a 14 day right to cancel.

A telephone order, or a call to pay a deposit and thus accept a quotation that you have received following a home visit or a visit to our showroom will not have an automatic right to cancel.

Canceling an order where goods have been delivered

All of the above conditions apply (a,b,c)

When goods have been delivered if an automatic right to cancel applies, the right to cancel period is 14 days from the point of delivery. In these circumstances the customer has the right to inspect goods but must return them unused, ie. in the same manor as inspecting them in a shop. Goods returned that have clear signs of use beyond the scope of what is reasonable or necessary to establish their nature, characteristics and function’ and as such have diminished the value of the goods will be subject to reasonable deductions.
